On September 23, 2004, at about 3:00 PM, [redacted] and [redacted] were outside [redacted], Queens, waiting for friends. Two officers, later identified as PO Donnell Myers and PO Andrew Tolson of the 107th Precinct, asked them to leave the area, to which they complied. Soon after during school dismissal, [redacted] attempted to approach the school again to meet his friends. [redacted] alleged that PO Myers forcibly stopped him, then pushed his shoulder into a nearby fence while attempting to handcuff him (Allegation A, [redacted]). The officers brought [redacted] to their nearby police vehicle, at which point [redacted] alleged that PO Myers struck his head against the door of the police vehicle (Allegation B, [redacted]). [redacted] was then placed inside the police van. A crowd had gathered at the location.
