On June 7, 2005 at approximately 6:30PM an unidentified perpetrator fired a gun in the vicinity of the corner of Irving Avenue and Linden Street in Brooklyn. A large crowd of civilians assembled prior to the arrival of the police. Several officers, including Sergeant John Zegilla, Police Officer Thomas O'Connor, Police Officer Bryan Zuccaro and Police Officer Ronald Perez, responded to the job and found shell casings in the street. While attempting to establish a crime scene, Officer O'Connor observed [redacted] standing in the street, in the midst of the ballistic evidence. [redacted] ignored Officer O'Connor's instructions to exit the crime scene. Instead, [redacted] was speaking to [redacted] and [redacted], both of whom were attempting to drive on Linden Street. Officer O'Connor approached [redacted] and instructed him once again to leave the crime scene. The two became engaged in a physical altercation that resulted in Officer O'Connor tackling [redacted] to the ground (Allegation A). Officer Zuccaro assisted in restraining [redacted] with the use of force (Allegation B). Officer Perez assisted (Allegation C), as did several unidentified officers (Allegation D). One unidentified officer ran to [redacted] and proceeded to kick and strike him with a baton (Allegation E).
