At approximately 6:35 PM on September 3, 2005, [redacted] set up a table with merchandise for sale in front of [redacted] located at [redacted] in Brooklyn. [redacted] had no vending license for the table. PO Erik Worobey of the 67th Precinct, acting under the supervision of Sgt. Robert Ward of the 67th Precinct, approached [redacted] and requested to see his permit (allegation A). [redacted] confirmed that he had no license. Officers proceeded to confiscate the merchandise when [redacted] attempted to retrieve some of the merchandise and fled into the store. PO Michael Rivera and PO Mark Vazquez of the 67th Precinct followed [redacted] into the store in order to arrest him for obstructing governmental administration. [redacted] resisted the arrest and PO Rivera discharged pepper spray (allegation B). PO Vazquez struck [redacted] one time with his asp (allegation C), causing no injury. [redacted] alleged that an officer placed him in a chokehold during the struggle (allegation D). [redacted] the daughter of [redacted] alleged that an unidentified female officer slapped her once in the face while [redacted] was being arrested (allegation E). At the same time, [redacted] exited the store and attempted to retrieve some of the merchandise from the table as well, at which time PO Worobey arrested her [redacted]. He used minor physical force to handcuff [redacted] which resulted in no injury (allegation F). While PO Worobey arrested [redacted], a relative of the [redacted] exited the store and approached PO Worobey in a menacing manner, telling him to release [redacted]. PO Fakrul Islam and PO Daniel Insogna of the 67th Precinct intervened and used physical force to arrest [redacted] (allegations G and H). No injury resulted.
