On November 23, 2005, at approximately 5:45pm, [redacted] and [redacted] were double parked in front of 14 West 125th Street in Manhattan. [redacted] remained in the vehicle, while [redacted] went inside the store Planet Earth. When he came out, he approached the marked patrol vehicle of two police officers, identified through investigation as PO Brian Davis and PO Walter Loor of the 28th Precinct, and discovered that he was being issued a summons. PO Davis and PO Loor exited their vehicle, and PO Davis told [redacted] to, "Get back in your fucking car before you get a summons" [Allegation A]. [redacted] replied, "Fuck you nigger, give me a summons." PO Davis repeatedly attempted to place his hands on [redacted] and ended up striking him with a nightstick [Allegation B]. [redacted] PO Davis and PO Loor ended up fighting in the street [Allegations C and D]. The officers tackled [redacted] to the ground, and PO Davis struck [redacted] with his nightstick repeatedly while PO Loor lay on top of him. [redacted] yelled at them to stop and moved close to the officers and [redacted] PO Davis struck [redacted] above her left eye [Allegation E]. PO Davis continued to strike [redacted] with the nightstick. PO Davis told [redacted] to "Get the fuck out of my face" and took his hand and shoved her in the face, forcing her to the ground [Allegation F]. PO Davis radioed for back up at this time, multiple officers arrived, and [redacted] was arrested and transported to the 28th Precinct.
