On April 12, 2006 at approximately 3:00 PM, [redacted] left her apartment located at [redacted] in the Bronx to go to the check cashing store and the pharmacy. As she walked north on [redacted] she noticed a Hispanic male riding a bicycle, identified during the investigation as [redacted] had never seen the male prior to this day and did not speak to him. At the intersection of [redacted], an officer (PO 1), described as a plain clothed, 5'10" muscular Black male wearing an olive green checkered shirt jacket, struck her from behind, threw her to the ground, and hit her on the right side of her body. PO 1 was subsequently identified during the investigation as PO Rolando Carbonell of Narcotics Borough Bronx. In her phone statement to IAB, [redacted] stated that a Black male punched her, threw her to the ground, and pushed her against a car. The officers did not allow her to leave and attempted to handcuff her, but she would not allow them to do so. In her statement to Sgt. Cronin, she added that PO Carbonell had a shield around his neck that read 2708. PO Carbonell lifted [redacted] who was screaming loudly in fear, from the ground and told her to be quiet.
[redacted] attempted to pull away from PO Carbonell, however he grabbed onto [redacted] right arm to prevent her from escaping. PO Carbonell then pushed [redacted] against a car that was parked on the sidewalk. As [redacted] was being held against the car she saw another officer (PO 2), described as a plain clothed 5'8" slightly heavier White male, identified during the investigation as Detective Felix Lopez of Narcotics Borough Bronx. Det. Lopez had stopped [redacted] and was searching him. [redacted] could not see how [redacted] was searched, but she knew that [redacted] pockets were entered. [redacted] did not make this allegation to IAB, hospital personnel or in her Notice of Claim.
