Summary

On July 11, 2006 at approximately 8:42 PM, [redacted] rode his bicycle along a pathway through the [redacted] Housing Development from [redacted] to [redacted] in Manhattan. He had a black backpack on his back, which contained tools such as pliers and telephone jacks. When [redacted] reached [redacted] between [redacted] and [redacted] he turned left onto the street and headed westbound. [redacted] heard, "Hey, hey. Hold it right there." [redacted] stopped, turned around and saw two uniformed officers on bicycles, PO1 and PO2, and approximately four uniformed officers on foot. PO1, later identified through investigation as PO Christopher Heredia, was described as a male with a brown complexion and a heavy build, 5'8", and in his late 20s. PO2, later identified through investigation as PO Christopher Kuehn, was described as a white or Hispanic male with a slim build, 5'5", and in his mid-20s. [redacted] immediately got off his bicycle and asked what the problem was. PO Heredia told [redacted] that he was on police housing grounds and that he could be searched. The officers told [redacted] to put his bag down and he placed it on top of a parked vehicle nearby. PO Heredia asked [redacted] if he had a knife or a gun and [redacted] responded that he did not. PO Kuehn asked for identification and [redacted] provided his name and driver's license number verbally because he was afraid to reach into his pockets. PO Kuehn requested a piece of ID and [redacted] provided his [redacted] identification card. PO Kuehn radioed the precinct to check if [redacted] had any outstanding warrants.
Without being asked by either officer, [redacted] took his keys and his wallet out of his pocket and placed them onto a parked vehicle. [redacted]'s pockets were empty except for a napkin. PO Heredia told [redacted] that he was going to have to search him because he was riding on sidewalks in the housing grounds.
