Description: On March 12, 2014, plaintiff was on his way to work and not engaged in any criminal activity, when defendant POs Fernandez, Hairston and Heredia, without a warrant or probable cause, stopped and arrested him. Plaintiff, who is African-American, was stopped because he vaguely matched the description of a man who had engaged in a drug sale during a "buy-and-bust" operation near the area. Defendant POs then signed a criminal complaint, knowingly relying on a false statement linking plaintiff with the drug sale. Defendant POs then prepared false police reports, causing plaintiff to be prosecuted and convicted for crimes he did not commit.

Description: On February 1, 2014, Plaintiff was lawfully walking on the sidewalk with his brother when NYPD Defendants approached him, failed to identify themselves, restrained him with physical force, and detained him by placing metal handcuffs on his person and placing him in an NYPD motor vehicle secured by locking mechanisms. Plaintiff was restrained and detained against his will and without probable cause or other legal justification. Defendants initiated criminal judicial proceedings against Plaintiff purposefully, and with malicious intent.
