When interviewed at the CCRB, [redacted] stated that on November 27, 2006, at approximately 10:30 PM, he went to the 75th Precinct stationhouse to file a complaint against [redacted], the tenant in apartment [redacted] in Brooklyn, [redacted]. The complaint was in regards to an incident that occurred on November 24, 2006, when [redacted] broke banisters in the apartment building and threatened [redacted] with a knife. Officers were supposed to contact [redacted] regarding the incident but had not done so by November 27, 2006, which prompted [redacted] to go to the 75th Precinct stationhouse in order to make the complaint.
No other civilians were at the stationhouse. While [redacted] was speaking to an unidentified female officer, the female desk sergeant asked [redacted] "Weren't you once arrested?" On March 22, 2007, [redacted] viewed a photographic array containing service photos of four officers from the 75th Precinct, and positively identified the sergeant as Sgt. Barbara Fischer. [redacted] told Sgt. Fischer in a quiet voice, "This has nothing to do with why I'm here now." According to [redacted] PO Jason Caputo and PO Javier Munoz were also at the stationhouse. He knew PO Caputo and PO Munoz because they arrested him in May 2006 for criminal mischief and third degree menacing, and he identified them during the March 22, 2007 photo array. PO Munoz told [redacted] to leave the precinct, but [redacted] refused and stated that he was there to file a compliant. PO Munoz told [redacted] that he made a "joke" out of Sgt. Fischer, but he later stated during the interview that it was a young white male officer said that. During his telephone statement on November 29, 2006, [redacted] stated that PO Munoz told him to talk to the sergeant nicely or else he would throw him out of the precinct with his "own bare hands." During the March 22, 2007 photo array, [redacted] said that PO Munoz told him to "watch [his] fucking mouth" and that PO Caputo told him, "Get the fuck out of here, you Jewish fucking slumlord."
