Summary

At approximately 12:30 PM on January 12, 2007, [redacted] went to visit his friend, [redacted] at [redacted] in Brooklyn. This building is managed by the New York City Housing Authority and is known to the NYPD as a drug-prone location. Approximately 45 minutes later, [redacted] exited the building and was observed doing so by PO Kenneth Douglas and PO Winston Willabus of the 90th Precinct SNEU team. These officers were parked in a car across the street and PO Douglas radioed PO Dennis Ferrer and PO Michael Manloris, informing them that they should question [redacted] (Allegation A) Accordingly, PO Manaloris and PO Ferrer approached [redacted] several blocks from [redacted], asked him to identify himself and questioned him regarding his presence at the building. (Allegations B and C). [redacted] was evasive and refused to answer certain questions because he felt he did not have to. During the stop, PO Ferrer frisked and searched [redacted] (Allegation D). PO Manaloris was said to have pulled out his extendable baton and dropped it, causing a woman to protest that it almost hit her, to which he allegedly responded, "Get the fuck out of here." PO Manaloris also allegedly made several obscene comments to [redacted] that the latter could not precisely recall. (Allegation E) Although [redacted] was not found to be in possession of any contraband, and had only been observed entering and exiting and NYCHA building, he was handcuffed and placed in the back of a patrol car. (Allegations F, G and H). [redacted] was removed to the 90th Precinct and lodged under a charge of trespassing. Sgt. Kenneth Tysdal then authorized PO Willabus to strip-search [redacted], but no contraband was recovered.
