Summary

On July 10, 2007, at approximately 10:10pm, Sgt. Dennis Bowen, PO Megan O'Malley, and PO Anzelmo Giovaniello, of Brooklyn South Narcotics, were driving on [redacted] towards [redacted] in Brooklyn. The officers observed three black males. Two males, identified as [redacted] and [redacted] were seated in the front seats of a parked sedan, and one male, identified as [redacted] was standing near the passenger side door. [redacted] and [redacted] were allegedly hunched over the dashboard, while [redacted] leaned towards the passenger side window from the sidewalk. Sgt. Bowen, PO Giovaniello and PO O'Malley had a discussion prior to exiting the vehicle and agreed that these actions were indicative of grand larceny. Sgt. Bowen made the decision to approach the individuals.
Sgt. Bowen approached [redacted] and allegedly told him, "Shut the fuck up," and said to place his hands on the vehicle (Allegations A and B). PO Giovaniello and PO O'Malley approached [redacted] and [redacted] (Allegation C). Sgt. Bowen conducted a frisk of [redacted]'s person (Allegation D). [redacted] alleged that Sgt. Bowen searched his pants pockets (Allegation E). [redacted] also alleged that during the course of the frisk Sgt.
