On September 2, 2007, at approximately 3:40 AM, [redacted] along with her sons [redacted] and [redacted] were at [redacted] to see [redacted]s other son who had been shot. As [redacted] entered the hospital, a male officer identified through investigation as PO Richard Fermin, accused [redacted] of pushing him. PO Fermin then allegedly pushed [redacted] in his chest (Allegation A) and then forcibly pushed [redacted] aside (Allegation B). Another officer, identified through investigation as PO Brendan Quinn, allegedly punched [redacted] in his face (Allegation C). At this point, numerous officers allegedly started punching and kicking [redacted] and their friend, [redacted] (Allegation D). [redacted] alleged that PO Quinn threatened to hit him with his gun when he was on the floor (Allegation E). [redacted] alleged that while he was being assaulted he was pepper-sprayed in his face, by an officer later identified through investigation as PO Cesar Gomez (Allegation F). After the incident calmed down, [redacted] and [redacted] were arrested and taken back to the 46th Precinct while [redacted] stayed at the hospital because of a heart condition.
