Defendant Detective Felix Garcia unlawfully entered and searched for Plaintiff’s stepbrother in Plaintiff’s apartment, without a warrant. Description: On October 16, 2022, Joel Capellan, son of Plaintiff Jenny Rodriguez (who is suing on Capellan's behalf) was attacked by unknown assailants on the street. Defendant Officers Cesar Gomez, Derek Rivera, Anthony Stabile, and Stephen Tomaszewski were present at the scene and - without announcing themselves as police officers - two of the four defendants fired 34 shots into Capellan's back. The other two officers, who were also present, did not intervene. Mr. Capellan died as a result of his injuries.

Description: On July 21, 2019, in the vicinity of East 112th Street and Fifth Avenue, defendant POs detained, stopped, frisked, searched and arrested plaintiff. Defendant POs also seized plaintiff's personal property, including his bicycle and cell phone. Defendant POs provided false information for prosecution of plaintiff. Plaintiff was held in custody until he was released on October 29, 2019. On November 15, 2019, defendant POs made testified falsely at a suppression hearing was held. On January 13, 2020, the judge issued a decision and order finding that the officers did not have reasonable suspicion and therefore, they were not permitted to frisk or search plaintiff.

Description: On or about June 16, 2013, Plaintiffs were lawful passengers in a motor vehicle when Defendant NYPD officers Pomerantz, Gomez, Ching, and other unknown Defendant officers, conducted a warrantless stop on the car without probable cause. The Defendants searched the vehicle and located an air pistol and shotgun, which were the lawful property of the vehicle's owner. The vehicle's owner immediately identified himself as the owner of the weapons. Despite that fact, the Defendants placed Plaintiffs under arrest and charged them with felony weapon possession. Plaintiffs were taken into custody and transported to central booking. All charges against the various Plaintiffs were eventually dismissed.
