Summary

On September 28, 2007, at approximately 12:00 p.m., officers assigned to the 90th Precinct Street Narcotics Enforcement Unit (SNEU) team observed [redacted] and [redacted] engage in a hand-to-hand drug transaction on the corner of [redacted] and [redacted] in Brooklyn. Sgt. Antonio Hernandez and PO Michael Manaloris approached [redacted] and attempted to handcuff him. [redacted] pushed Sgt. Hernandez when he grabbed hold of him and Sgt. Hernandez punched [redacted] in his lower lip (Allegation A) while PO Manaloris grabbed hold of his arm (Allegation B). PO Winston Willabus also approached and tried to restrain [redacted] by holding onto his arms and legs (Allegation C). [redacted] continued to resist and PO Manaloris struck several times in his legs with his asp (allegation D). [redacted] also alleged that Sgt. Hernandez struck him with his asp (Allegation E). Meanwhile, other officers from the 90th Precinct SNEU team arrested [redacted] several blocks away without incident. PO Manaloris called for backup. PO Kevin Hutchinson, PO Kenneth Douglas, and PO Dennis Ferrer, also of the 90th Precinct SNEU team, responded. With their assistance, the officers handcuffed [redacted] and [redacted] were arrested for criminal possession of a controlled substance in the third degree and transported to the 90th Precinct. [redacted] was additionally charged with criminal sale of a controlled substance in the third degree, resisting arrest, and assault against a police officer.
At the 90th Precinct, Sgt. Hernandez authorized the strip-search of [redacted] (Allegation F). Several members of [redacted]'s family went to the precinct, including [redacted] and [redacted]. An ambulance was called for [redacted] who received and injury during his arrest. As [redacted] was being loaded into the ambulance, [redacted] asked PO Douglas where [redacted] was being taken.
