On October 5, 2007, at approximately 6:30am, [redacted] was home with numerous other family members that also reside in the location, including [redacted] s fiancée; [redacted] s sister; [redacted] Is daughter; and [redacted] brother, who resides in the basement. Officers, supervised by Lt. Larry Burnham of Narcotics Borough Brooklyn South, were executing a search warrant on the home and in doing so rammed the front door down [Allegation A]. While the officers were entering the home, [redacted] alleged that an unidentified male officer called her a "bitch" through the front door [Allegation B]. Det. Charles Martello, of Narcotics Borough Brooklyn South, ran up the stairs to the second floor of the home. [redacted] and [redacted] were standing in the second-floor hallway screaming. Det. Martello allegedly stated, "Shut up, black bitch. All you black bitches get the fuck back in your rooms.” [Allegation C] An unidentified officer said, "These women are all screaming, I don't know why they can't shut the fuck up." [Allegation D]
[redacted] alleged that Det. Martello charged into her, punched her in the stomach, and spit in her mouth and on her face [Allegation E]. [redacted] began to urinate and vomit on herself because of being punched. She allegedly urinated on Det. Martello because he was still on top of her. Det. Martello allegedly said, "Oh, you fucking bitch, you pissed on me." [redacted] was standing in the hallway handcuffed and began talking to [redacted]. Det. Martello allegedly turned around and said, "Mind your fucking business, you black bitch." [redacted] said, "I'm just about the same complexion as you, so how are you gonna call me black? You don't know what I am." Det. Martello allegedly grabbed [redacted] threw her down, and kicked her with his right foot [Allegation F].
