Summary

[redacted] stated that on October 5, 2007 at approximately 8:00pm, he parked his red Toyota Camry in front of his sister's residence at [redacted] in Brooklyn. He had a male passenger, [redacted] in his passenger seat, and at the time, another resident of [redacted] was sitting on the building's front steps. [redacted] claimed that he was inside his apartment at the time with his friends [redacted] a male named '[redacted]' and an unidentified female. Shortly after parking, officers from the 81st Precinct module of Bronx Narcotics converged on the location to effect a search warrant; several of the officers entered [redacted]'s residence at [redacted] and proceeded to search it [Allegation A]. Other officers approached [redacted] and [redacted] with their guns drawn and pointed [Allegation B] and allegedly told both [redacted] and [redacted] to "shut the fuck up" and "get out of the car" [Allegation C]. [redacted] also claimed that officers referred to him numerous times as a "motherfucker," as well as used profane language toward him throughout the entire incident. The officers pulled [redacted] and [redacted] from the red vehicle, allegedly pushing [redacted] to the ground [Allegation D]. [redacted] and [redacted] were all placed under arrest for smoking marijuana together outside the residence prior to the officers' arrival. [redacted] told the arresting officers that they were free to search his car, at which time, officers including Det. Jamil Payne then proceeded to search the vehicle.
