Summary

[redacted] stated that at approximately 5:30pm on November 29th, 2007, he was moving two 4x4 feet windows from the house of his friend's neighbor, whom he identified as [redacted] and taking them to another friend, [redacted] to see if he could sell them to him. [redacted] lives at [redacted] between Broadway and Bushwick Avenue. [redacted] was replacing her windows and gave [redacted] permission to sell the old ones. [redacted] was pushing the windows in a shopping cart in the street on Broadway, near the corner of Putnam Street. Two officers in plainclothes pulled up in an unmarked car and approached [redacted]. PO #1 was a 5'7" white male, who was later identified through investigation as PO Thomas Hardell and PO #2 was a 5'7" black male, identified through investigation as PO Kaz Daughtry. PO Hardell asked [redacted] if he had a bill of sale for the windows and he told them that he did not because he was moving them for a friend. [redacted] told the officers that he could take them to his friend. PO Hardell said, "Is it alright if I search you?" [redacted] responded, "For what?" At that point, PO Hardell grabbed [redacted] shoulders and pushed him face first onto the hood of a parked car. [redacted] feet were still on the ground. PO Hardell had not said anything to [redacted] and [redacted] shouted, "Police brutality." [redacted] face was against the windshield. PO Hardell jumped onto the hood of the car and put his knee on [redacted] neck, causing [redacted] to have difficulty breathing. PO Hardell punched [redacted] in the face and all over his body. [redacted] left eye became bloodshot as a result, at which time PO Daughtry started beating [redacted] with a "blackjack," which is a long stick with a perpendicular handle. PO Daughtry hit [redacted] in the back and the backs of his legs, however he could not articulate how many times. The officers handcuffed [redacted] and searched him, at which point they found a marijuana blunt in a cigarette box in his pocket. Uniformed officers arrived and transported...
