On April 23, 2007, at approximately 10:53 AM, [redacted] arrived at [redacted] Auto which is located at [redacted] in the Bronx. He had an argument with [redacted] in regards to fixing his vehicle and had a Kabudo karate stick in his possession. [redacted] called the police and PO Starlin Dominguez and PO Glynis Andino, both assigned to the 48th precinct, responded. [redacted] raised his voice to PO Dominguez and told him what happened. At some point, [redacted] fell without having any physical contact with anyone, although it is unclear how he fell and what part of his body made contact with the ground. [redacted] then swung his hand at PO Dominguez who stepped back and pushed [redacted] to avoid being hit. [redacted] fell after he was pushed (Allegation A). While [redacted] was on the ground, PO Dominguez attempted to handcuff him. [redacted] physically resisted, at which point PO Dominguez grabbed [redacted]s hands to handcuff him (Allegation A continued).
