On June 22, 2008 at approximately 11:45pm in the vicinity of [redacted] in Manhattan, PO Scott Orenstein, PO Andrew Fitts, and PO Jonathan Ringel were met by [redacted] who alleged that [redacted] recently choked and threatened to kill her. She told the officers she wanted [redacted] out of her apartment. The officers followed her to her apartment. PO Orenstein knocked on the door until [redacted] opened it. There was a brief conversation before PO Orenstein entered [redacted] apartment (Allegation A) Then PO Orenstein allegedly grabbed [redacted] by his neck, pushed him against a wall and began to arrest him (Allegation B). PO Fitts and PO Ringel followed PO Orenstein into the apartment (subsumed in allegation A). Then PO Fitts and PO Ringel allegedly punched [redacted] (Allegations C and D). [redacted] was arrested and taken to the PSA 5 stationhouse. Following his release on June 23, 2008, he returned to the PSA 5 stationhouse at approximately 3:00pm to file a written complaint.
