On July 3, 2008, at approximately 3:12 AM, PO Christopher Derenze and PO Craig Jacob, both assigned to the 32nd Precinct, effected a car stop of the vehicle in which [redacted] an occupant. [redacted] was pulled over on 7th Avenue and 135th Street in Manhattan for excessive window tints and a loud car exhaust. His friend, [redacted] was seated in the front passenger seat and [redacted]s nephew, [redacted] (unknown last name), was seated in the rear of the vehicle. PO Derenze asked [redacted] to exit the vehicle several times and [redacted] refused to comply. PO Derenze and PO Jacob pulled [redacted] out of the vehicle (Allegation A and B). [redacted] alleged that he heard an officer, whom he did not observe, tell [redacted] "Put your fucking hands up, keep your fucking hands up (Allegation C)." He also stated that he saw a gun pointed at [redacted] but did not observe the officer who allegedly pointed it (Allegation D). After [redacted] was removed from the vehicle, he was placed on the ground. He alleged that while he was on the ground, he was kneed in his lip and was kicked on his torso (Allegation E). [redacted] alleged that Sgt. Alfred Gallicchio, assigned to the 32nd Precinct, told him to, "Say something now, fucking tough guy" and pushed him into a parked vehicle (Allegations F and G). [redacted] alleged that he observed his vehicle being searched by several officers, whom he could neither describe nor identify (Allegation H). [redacted] alleged that when his vehicle was returned to him, he observed damage to the vehicle that was not there before he was arrested. [redacted] and [redacted] were neither arrested nor issued summonses. [redacted] was transported to the 32nd Precinct stationhouse. At the stationhouse, he alleged that PO Derenze called him a "jerk-off", that Sgt.
