Summary

On September 16, 2008, at approximately 8:00 PM, [redacted] was sitting in his car, a 2005 maroon Mercury Montigo premier, on 12th Street and 33rd Road, in Queens, a couple of blocks away from his neighborhood. He described the location as secluded with factories. Across the street, there was a baseball field that belonged to Long Island City high school. [redacted] had just finished washing his car. [redacted] often goes there after work and sits there for a few minutes just to relax. On that day, [redacted] was sitting in his car listening to the radio, when an old 15-seater white van pulled up in the opposite direction in front of his car. The van stopped and two plainclothes bald white male police officers under 40 years of age exited the van and approached [redacted]'s car. Detective Bryan Zucarro was about 5'7 and had an average build and Detective Kevin Pecorella was stockier and a little taller than Detective Zucarro. [redacted] drove to the 114th Precinct after the incident and inquired about the identity of the officers. The desk sergeant provided him the names of Detective Zucarro and Detective Pecorella and the license plate number of the vehicle they were driving. Detective Zucarro had a shield displayed as he approached [redacted]'s car by the driver's seat window. He asked [redacted] for his license and [redacted] began to reach for it in his back pocket and simultaneously asked, "What seems to be the problem?" Detective Zucarro then said, "Well, what's the matter? What's wrong with you?" [redacted] told the officer that he [redacted] was a little agitated or aggravated. Detective Zucarro then ordered [redacted] out of the car.
