Summary

On January 31, 2014, at 9:00p.m., [redacted] was driving a Chrysler 300, which had tinted windows and belonged to his sister, [redacted] who was a passenger, along with his two friends. The car was pulled over in front of [redacted] in Staten Island by PO Genaro Barreiro, PO Frederick Daley, and PO Carlos Rueda, of the 121st Precinct, who were in a marked van. [redacted] was told she was going to receive a summons for drinking a beer while in the car. While the officers began writing the summons, [redacted] who had been leaving the home where his son leaves, approached, told the officers to leave [redacted] alone, and refused repeated requests to step away from the scene and go back into his home. An argument ensued, and PO Barreiro and PO Rueda allegedly used discourteous language with [redacted] (Allegation A and Allegation B). [redacted] was pushed against a retaining wall and after offering some resistance, was handcuffed. [redacted]'s step-son, [redacted] and [redacted] mother, [redacted] came running out of the house. [redacted] ran at the officers who were arresting [redacted] PO Barreiro put his hand out and pushed [redacted] in the face, causing him to be pushed backward (Allegation C).
