On May 8, 2014, at approximately 6:45 pm, [redacted] called 911 to report that his landlord [redacted] had locked him out of his apartment, which was located in the basement of 165-14 119th Avenue in Queens. PO Connie Duncan and PO Kyle Bradley responded to the location and after briefly speaking with [redacted] at the front door, they went around to the backyard with [redacted]. Soon after arriving in the backyard, [redacted] opened the backdoor and released two full grown pit bulls into the backyard. The dogs ran towards PO Duncan and PO Bradley and both officers discharged their firearms at the dogs, striking one of them in the front and rear legs (Allegations A, B, C, and D). The dogs were brought back inside and PO Duncan requested additional units to the location. Approximately 30 minutes later, members of the 113th Precinct Detective Squad persuaded [redacted] her two sons [redacted] and [redacted] and her estranged husband [redacted] to exit the house and they were all placed under arrest. When [redacted] stepped into the front yard, Det. Brian Heerey of the 113th Precinct Detective Squad allegedly said to [redacted] "You fucking crazy? You put the fucking dogs on the cops?" (Allegation E). Subsequently, eight ESU officers entered the residence, searched for the dogs and then brought them outside in nooses (Allegation F). While the ESU officers were inside, they allegedly broke several pieces of electronic equipment and a basement door was broken off of its hinges (Allegation G). On May 9, 2014, at approximately 10:30 pm, PO Ryan Quarte transported [redacted] from the 113th Precinct stationhouse to Queens Central Booking, during which time he allegedly told [redacted] "You sent the fucking dogs on the cops," "You're fucking going to jail," and "You're fucking crazy," (Allegation H).
