Summary

On June 4, 2014, at approximately 6:30 a.m., [redacted] and his son, [redacted] were inside their apartment at [redacted] in the Bronx. The apartment's doorbell rang and [redacted] heard two loud bangs from the front door. The door opened and approximately five officers in helmets and shields entered the apartment with their guns drawn (Allegation A). When the officers opened the door, the locks were broken off and the ram made a large hole (subsumed within Allegation A). [redacted] repeatedly asked the officers what was going on and lifted his head while the officers held him on the ground, but they did not answer his questions and told him to "shut the fuck up" (Allegation B). The officers then pushed [redacted] and [redacted] to the ground and handcuffed both of them. An officer holding a four foot long cylindrical bar dropped this bar and it hit [redacted] in the head (Allegation C). Lt. John Eagan entered the apartment and told [redacted] that the officers had a warrant for [redacted]'s arrest. Lt. Eagan asked [redacted] if he had drugs in the apartment and [redacted] replied that he did not know what the officers were talking about. Lt. Eagan told him not to "play that fucking game" and said he would "tear the fucking apartment apart" (Allegation D). [redacted] was then escorted outside the apartment and taken into custody. Several officers then searched every room in the apartment and removed many items from cabinets and drawers (subsumed within Allegation A).
