On August 1, 2014, Det. Milton Valerio of Narcotics Bureau Manhattan North was assigned to an observation post on the rooftop of a five-story building in the vicinity of West 114th Street and Adam Clayton Powell Jr. Boulevard in Manhattan. At approximately 7 p.m., Det. Valerio made an observation involving [redacted] and relayed his observations to Sgt. Michael Alieso and Det. Victor Cardona of Narcotics Bureau Manhattan North, who were part of the field team in the incident area (Allegation A).
It is undisputed that Sgt. Alieso and Det. Cardona approached [redacted] from behind as he was crouched towards his boot and immediately handcuffed him. Det. Cardona then frisked [redacted] left boot, left sock, and waistband (Allegation B). [redacted] alleged that Sgt. Alieso frisked and searched his left sock, left boot, and both of his front pants pockets (Allegations C and D). After the negative frisk and search, Det. Cardona uncuffed [redacted] and the officers attempted to explain to [redacted] why he was stopped. The officers did not take [redacted] information and released him with no summons.
