Summary

On July 20, 2015, [redacted] was arrested for assault by PO Gregory Johnson. He was taken to the [redacted] for processing. While in the holding cells, [redacted] acted in an agitated and aggressive manner, and started striking his head against the cell bars. As a result, Sgt. Zhang decided to treat [redacted] as an emotionally disturbed person (EDP) and have him removed from the stationhouse to a hospital for treatment. Sgt. Zhang requested both EMS and ESU to respond to the stationhouse to help move [redacted].
Two ESU officers, Det. Richard Reilly and Det. Eric Shanley, responded to the call. EMT [redacted] and EMT [redacted] also arrived. Det. Reilly and Det. Shanley entered the holding cell to retrieve [redacted]. He was already in handcuffs at the time. The ESU officers placed shackles on his legs as well. [redacted] was moved up onto the stretcher. He resisted the officers by attempting to twist his body away from them. One of the officers responded by punching [redacted] once in the face (Allegation A).
[redacted] was then strapped onto the stretcher and rolled out to the front desk. Several precinct officers, including Sgt. Brian Bartley and PO Mark DeMarco, were standing by the desk. Sgt. Zhang stood behind the desk. [redacted] asked Sgt. Bartley for his shield number. Sgt. Bartley provided his shield number verbally. He then told [redacted] "I'll tattoo it on your forehead, fuckface" (Allegation B). [redacted] replied by spitting on several of the officers, including Sgt. Bartley. Sgt. Bartley, PO Johnson and the ESU officers then punched [redacted] several times in the face (Allegations C, D, E and F). [redacted] was then taken off the stretcher and placed into a mesh restraining bag. Once held in the bag, [redacted] was removed to an ambulance and taken to Kings County Hospital for treatment.
