Summary

On June 24, 2014, at 7:12 p.m., [redacted] was allegedly involved in a motor vehicle accident in the Forest Promenade Shopping Center parking lot at 985 Richmond Avenue in Staten Island while waiting for his wife who was inside the store. PO Brian Mullarkey responded to the scene and requested that [redacted] provide his identification. PO Mullarkey claimed [redacted] did not remove his license from his wallet fast enough and proceeded to handcuff [redacted]. PO Mullarkey then took [redacted] Is wallet from him and found a PBA card in it. PO Mullarkey told [redacted] "You can take that and stick it up your ass" (Allegation A). PO Mullarkey issued two summonses to [redacted] one for disorderly conduct and another for the unlicensed operation of a vehicle. Then, PO Mullarkey said to [redacted], "You know why I did this? You're a smart ass." When [redacted] asked PO Mullarkey why he was being issued a summons for being an unlicensed driver when he was not the driver of the vehicle, his wife was, PO Mullarkey replied, "Shut the fuck up or I'll take you to jail.
