Summary

On December 3, 2014, at 11:24 p.m., after visiting their friend who resides in the building, [redacted] and [redacted] stood in the lobby of [redacted] a NYCHA building in Brooklyn, hugging and kissing each other for less than ten minutes. Then, PO Eumir Ferrer and Frank Gambina of PSA1 approached [redacted] and [redacted] and asked [redacted] and [redacted] what they were doing in the building. [redacted] replied she and [redacted] had been visiting a friend and that she and [redacted] were just saying goodbye to each other. PO Ferrer informed them they were trespassing, and asked [redacted] and [redacted] for their identification (Allegations A, B, C and D). [redacted] took her phone out to call her friend. PO Ferrer allegedly snatched the phone from [redacted]'s hand three times (Allegation E). [redacted]'s identification was returned to him but the officers held onto [redacted]'s. The officers called for additional units to respond and [redacted] called 911 to file a complaint with IAB. [redacted] proclaimed she was going outside to smoke a cigarette and when she opened the front door to step outside, PO Ferrer gave [redacted] a small shove with his hands on her shoulders to make her return into the building (Allegation F).
