In the 125th Street ABCD subway station, a man was waiting for a friend to come up from the subway when he was stopped and questioned by two officers who claimed he had been gesturing to solicit a swipe from others leaving the station. The officers detained him and asked for identification. A Transit Bureau officer, Ramon Maldonado approached and handcuffed the man. The officers checked as to whether the man had any open warrants and released him when they determined that he did not.
The man claimed that Officer Maldonado cursed at him and that when he asked for names and badge numbers, Officer Maldonado walked away. The MTA video of the incident showed that he had not been gesturing for a swipe. The paper on which he had written down the names and badge numbers showed that he had the other officers' information but not Officer Maldonados.
The CCRB found that the stop was improper, and that Officer Maldonado had failed to provide his shield number and spoken discourteously. It is not clear from the interview statements what the basis for the false statement was.
Officer Maldonado was found not guilty after an administrative trial.
