On May 18, 2015, at approximately 8:40 p.m., [redacted] swiped her Metro Card at a turnstile at the Jay Street- MetroTech A/C line subway station in Brooklyn. As [redacted] was placing her wallet inside her backpack, [redacted]'s Metro Card swipe timed out. [redacted] waited for a disembarking customer to exit through the emergency gate and she entered the station once someone opened the gate. As [redacted] was descending the stairwell to the Manhattan-bound train platform, PO Jaswant Dyal from Transit District 30 approached [redacted] and allegedly said, "Where the fuck you going?" (Allegation A). PO Dyal then allegedly called [redacted] either a "bitch nigger" or a "nigger bitch." (Allegations B and C) [redacted] did not recall the exact order of the phrasing. PO Dyal asked [redacted] for her ID several times, but [redacted] refused to provide it and only offered to give PO Dyal her Metro Card. PO Dyal's partner, PO Leonardo Deoliveira from Transit District 30, also spoke with [redacted] and asked her to cooperate with PO Dyal. [redacted] eventually provided her ID to PO Dyal, who issued her a summons for [redacted]. After receiving the summons, [redacted] went to the Transit District 30 stationhouse in Brooklyn to file a complaint against PO Dyal. The desk officer, Sgt. Rasheda Edness, allegedly refused to process [redacted]'s complaint, telling [redacted] that there was nothing that she could do (Allegation D).
