Summary

On July 9, 2015 at approximately 11 p.m., [redacted] went to the 42nd Precinct stationhouse because he was under the influence of cocaine laced with an unknown substance that caused him distress and wanted the police to help him get to New Jersey. An officer inside the stationhouse told him to leave. [redacted] left the stationhouse and began screaming. A group of five to six plainclothes officers allegedly came outside, grabbed [redacted] dragged him face-down along the sidewalk, and threw him on the ground. [redacted] stood up and the officers allegedly punched him ten or more times in the face, back, and head, and kicked him about five times in the face and legs (Allegation A).
[redacted] was not arrested during the above incident. An FDNY ambulance responded to the stationhouse and transported him to [redacted] (see Privileged Documents). Sometime in the early hours of July 10, 2015, [redacted] walked out of the hospital without being medically discharged. At 1:57 a.m., he walked into a parking garage at [redacted] and began opening the doors of cars. The lot attendant, [redacted] called the police. [redacted] left, and PO Jason Lopez and PO Michael Riggio found him at [redacted] allegedly attempting to break into the building with a credit card. The officers approached [redacted] PO Lopez allegedly told [redacted] to "suck (his) dick," and the officers punched him about fifteen times in the face and head and kicked him five or more times in the legs (Allegations B, C, and D).
