Description: On August 21, 2019, Plaintiff was alone in a holding cell at the 42nd Precinct when another inmate entered the processing area of the precinct. Plaintiff overheard the individual tell P.O.s Duncan and others that he wanted a cell by himself or else “there would be trouble,” and identify himself as part of the gang “SMM.” With knowledge of potential harm that could be caused to Plaintiff, P.O.s placed the individual who was not handcuffed or restrained, in a jail cell with Plaintiff. As a result, the individual assaulted Plaintiff immediately upon entering the cell.
