Summary

On September 25, 2015, at approximately 3:30 a.m., [redacted] was walking his dog with his brother [redacted] on [redacted] in Brooklyn when Sgt. John Musante, PO Nelson Ayala, PO Joseph Andersen, and PO Michael Hansson chased [redacted] in an unmarked RMP towards his apartment building at [redacted] (Allegation A). The officers suspected [redacted] of attempting to break into a parked vehicle. The officers entered the building and [redacted] entered [redacted] and attempted to close the door. One officer allegedly held the door open with his foot while three officers allegedly attempted to push the door open (Allegation B). PO Ayala and PO Andersen pulled [redacted] out of [redacted] and into the hallway (Allegations C and D). PO Hansson frisked (Allegation E) and then handcuffed [redacted]. PO Ayala and PO Andersen entered the apartment and searched the backpack that [redacted] was allegedly wearing when the pursuit began, but discovered that there was nothing noteworthy in the backpack (Allegation F). While in the hallway, [redacted] discussed a prior arrest with one of the officers, who told [redacted] that he did not "beat the shit out of" him (Allegation G).
