Police Officer Drury responded to a call that teenage boys were smoking cannabis. After he and another officer arrived on the scene, the boys tried to leave. Officer Drury caught one of the boys, and in the process of arresting him struck him with his nightstick while he was on the ground.
A woman driving by observed Officer Drury hitting the boy, stopped her car, and asked him why he was hitting the boy with his nightstick. Officer Drury told her to "mind your fucking business." She asked him for his name and badge number, which he failed to provide. She went to the precinct to file a complaint. Officer Drury later arrived at the precinct, where she identified him to the other officers.
While Officer Drury denied cursing at the complainant or refusing to take a complaint, a police sergeant who had been called to the scene and who spoke with Officer Drury in the stationhouse after the complaint had been filed testified that Officer Drury confirmed he had cursed at the woman.
The CCRB was unable to obtain a statement from the person hit with a nightstick and could not determine whether the force was justified. It substantiated allegations of discourtesy, failure to provide name & shield, and failure to process a complaint against Officer Drury.
It likewise found that he made a false statement in those portions of his testimony contradicted by other PD witnesses. Officer Drury resigned from the NYPD before any discipline was imposed.
