Summary

On December 7th, 2015, at approximately 12:45 am, [redacted] and her boyfriend [redacted] were standing in the vestibule of [redacted] in the Bronx, where [redacted] lives, while awaiting a taxi for [redacted]. While waiting, [redacted] realized that he had left his mobile phone at [redacted]'s apartment: he quickly handed his backpack to [redacted] and ran back into the lobby, separated from the vestibule by a short staircase. As [redacted] ran up the stairs, three uniformed officers entered the vestibule from outside. One of these officers stated "wait - why are you running." [redacted] stopped and replied that he was not running, but going to get his phone. This officer then asked [redacted] to come back down (Allegations A, B, C). [redacted] returned to the vestibule, where [redacted] was still standing with the backpack. The officer then asked [redacted] for identification, inquired about the contents of his backpack, and then told him to go "get your stuff." When [redacted] went upstairs, another officer then asked [redacted] to hand him the backpack (Allegations D, E, F), which he allegedly opened and searched (Allegation G). Simultaneously, a third officer allegedly spoke offensively to [redacted]: he called her a "whore," and a "Section 8 bitch," and said she had a "silly ass attitude," for the "crappy building" she lived in (Allegations H, I, J).
