Summary

On February 21, 2016, at approximately 11:25 a.m., [redacted] was parked in front of [redacted] in the Bronx when he was approached by two police officers, identified by the investigation as PO Ryan Loomis and PO Declan Ludington of Strategic Response Group 2. In the course of their interaction, PO Loomis ordered [redacted] to step out of the vehicle. [redacted] replied to PO Loomis' command by saying that he felt he was being harassed. PO Loomis replied, "Did I fucking harass you?" (Allegation A). [redacted] also alleged that PO Loomis used the word "fuck" two further times during their interaction, but could not be more specific about the context in which these uses of profanity occurred. [redacted] eventually stepped out of the vehicle. PO Ludington handcuffed [redacted] though [redacted] did not himself allege this (Allegation B). PO Loomis acknowledged that he frisked [redacted]. PO Loomis also searched [redacted]'s vehicle (Allegation C). PO Loomis issued [redacted] a VTL summons for obstructing vehicular traffic (BR 02).
