Summary

On June 1, 2016, [redacted] was standing on the sidewalk of Mount Morris West at the entrance to Marcus Garvey Park near 120th Street in Manhattan when a white van pulled over and Det. Gregory Carty of Narcotics Borough Manhattan North "jumped" out onto the sidewalk. Det. Carty shouted something and [redacted] began to walk his bicycle southbound on Mount Morris West, away from Det. Carty. Det. Carty grabbed [redacted]'s shirt by his right shoulder and began to hit [redacted] on his legs and arm roughly five times with an asp as he yelled out he was an officer (Allegation A). At the same time, Det. Carty used his hand on [redacted]'s shoulder to push him down to the ground (Allegation B). Det. Carty stopped hitting [redacted] with his asp and had [redacted] sit up against the fence of the park. They waited for a few minutes and other officers started to arrive. Det. Carty and another officer assisted [redacted] to stand and he was escorted to the white van. After approximately ten minutes of waiting in the van, four to five arrested individuals were brought into the van and they were transported to the 25th Precinct OCCB hub site. [redacted]'s stated his photograph was taken by Det. Carty. However, his arresting officer was Det. Manuel Cordova. An hour later, Det. Cordova released [redacted] with a Desk Appearance Ticket for [redacted] to [redacted] [DAT BR 05; arrest report NYPD 03]. [redacted] claimed Det. Carty planted drugs on him, as a reason to arrest him. [redacted] denied having any controlled substances on his person at the time of his arrest. Det.
