On June 5, 2016, at approximately 12:30 a.m., at Navy Street and Park Avenue in Brooklyn, [redacted]'s friend, [redacted] drove [redacted]'s rental car with [redacted] seated in the back seat and [redacted]'s other friend, [redacted] seated in the front passenger's seat when PO Jonathan Martinez, Sgt. Frank Aliffi, and PO Cameel Quallis of the 88th Precinct stopped the civilians' vehicle (Allegations A, B, and C). The officers instructed the civilians to exit the vehicle, and [redacted] complied. PO Martinez and Sgt. Aliffi allegedly frisked and searched [redacted] (Allegations D and E, F, and G). [redacted] protested the officers' actions, and Sgt. Aliffi allegedly said, "Shut the fuck up" (Allegation H). Sgt. Aliffi allegedly opened the back passenger's door, grabbed [redacted]'s arm, and pulled him out of the vehicle (Allegation I). Sgt. Aliffi then allegedly frisked and searched [redacted] (Allegations J and K). [redacted] protested Sgt. Aliffi's actions, and Sgt. Aliffi allegedly said, "Shut the fuck up. You don't know what the fuck you're talking about" (Subsumed within Allegation H). The officers arrested [redacted] and [redacted] for [redacted]. [redacted] was also charged with [redacted] and [redacted]. [redacted] was charged with [redacted]. [redacted] was released without being arrested or issued a summons.
Additional officers, including PO Clark Taylor; PO Javier Colon; and PO Terence Culkin of the 88th Precinct, arrived on the scene after [redacted] and [redacted] were arrested, and PO Taylor and PO Colon attempted to place [redacted] into their police vehicle to be transported to the 88th Precinct stationhouse. [redacted] refused to enter the vehicle, and PO Taylor allegedly pushed [redacted] into the car while PO Colon pulled him into the car from the inside (Allegations L and M).
