Summary

[redacted] filed this complaint in-person at the CCRB on June 22, 2016, nearly three months after the incident date. On April 5, 2016, at approximately 5:50 PM, [redacted] parked his vehicle on the 52nd Avenue side of Corona Pizza, located at 51-23 108th Street, in Queens. Also inside his vehicle were his uncle, [redacted], his cousin, [redacted], and a friend, [redacted]. [redacted] and [redacted] exited the vehicle and entered the pizzeria while [redacted] and [redacted] remained inside of the vehicle. [redacted] placed an order, exited the pizzeria, and returned to his vehicle.
As [redacted] and [redacted] sat in the vehicle waiting for [redacted]. Sgt. Minh Tran, PO Christopher Musa, and PO Christopher Sanchez of the 110th Precinct Anti-Crime team arrived in an unmarked RMP, which they parked in front of [redacted]s vehicle. The officers exited the RMP, approached, and ordered [redacted] and [redacted] out of the vehicle (Allegations A, B, and C). The three men complied. [redacted] removed his cell phone from his pocket and began to record the incident, but PO Musa allegedly took the phone from [redacted]s hand and told him that he could not record (Allegation D). PO Musa then frisked [redacted] (Allegation E) while PO Sanchez allegedly frisked [redacted] and [redacted] (Allegations F and G). PO Sanchez then allegedly searched [redacted] (Allegation H). The officers guided [redacted] and [redacted] to the rear of [redacted]s vehicle. Sgt. Tran and PO Musa then allegedly searched [redacted]s vehicle (Allegations I and J). PO Musa recovered half of a Xanax pill from somewhere inside of the vehicle. [redacted] and [redacted] each denied ownership of the pill, and thus all three were placed under arrest.
PO Sanchez placed [redacted] in handcuffs and guided him toward the RMP.
