Summary

On October 31, 2016, at approximately 8:30 p.m., [redacted] his stepfather, [redacted] his step brother, [redacted] his coworker, [redacted] and two female cousins went to the Halloween parade near Bleecker Street in lower Manhattan. After spending some time in the area, [redacted] and his party decided to leave and began walking towards the A train subway station. [redacted] needed to urinate, so he went into an alley on Bleecker Street, approximately 20 feet away from the street, and urinated. Afterward, [redacted] returned to his party and continued walking towards the subway. Approximately one block away from where he had urinated, at Bleecker Street and Macdougal Street, [redacted] was stopped by PO Jonathan Dones and PO Joseph Branca, who asked [redacted] for his ID (Allegations A and B). [redacted] did not provide his ID, but ran from the officers instead. PO Dones and additional officers pursued [redacted] and tackled him to the ground. While on the ground, an officer allegedly punched [redacted] in his torso several times and kneed him in his back a few times (Allegations C and D). After [redacted] was placed in handcuffs, he heard an officer allegedly threaten to arrest [redacted] (Allegation E). [redacted] was then transported to the 6th Precinct stationhouse. At the stationhouse, PO Dones allegedly told [redacted] to "man up" and to "stop being a little bitch" (Allegation F). [redacted] requested medical attention for his asthma after he had a physical altercation with a fellow prisoner and was subsequently transported to an urgent care facility. At the facility, PO Dones allegedly told [redacted] once more to "man up" and to "stop being a little bitch" (within Allegation F).
