Summary

On November 30, 2016, at approximately 7:30 a.m., [redacted] and her home health aide, [redacted] were inside her apartment at [redacted] in the Bronx. At that time, NYPD Officers, US Marshals, and ATF Agents from the Joint Fugitive Task Force knocked on her door. Among the NYPD officers were Sgt. David Echeverria, Det. Salamir Taylor, Det. Finbarr Fleming, Det. Ellis DeLoren, and Det. William Shierle. Lieutenant Keith Smith was on-scene during the incident, but allegedly did not go to the apartment. These officers were acting on information provided by Det. Kieran Keenaghan and in pursuit of fugitive [redacted] who was wanted on a federal arrest warrant for [redacted] was known to be in a romantic relationship with [redacted] son [redacted] and [redacted] opened the door and were instructed to stay in the hallway by officers. Members of the Task Force including Det. DeLoren then entered and searched the apartment for [redacted] with the approval of Lieutenant Smith, Sgt. Echeverria and his federal counterparts (Allegations A and B). While the entry team was inside the apartment, [redacted] called [redacted] daughter, [redacted] who briefly spoke on the phone to Sgt. Echeverria. After confirming that [redacted] was not inside the apartment, the Task Force left the scene. This incident was observed by a neighbor known only as [redacted].
On December 3, 2016, at approximately 5:00 p.m., [redacted] and [redacted] were outside walking their dog when they received a call from a neighbor informing them that officers returned to their apartment. [redacted] called [redacted] who told her to return to the apartment with [redacted]. When [redacted] and [redacted] reached the apartment door, they observed Sgt. Echeverria, Det. Keenaghan, Det. Taylor, Det. Fleming, Det. DeLoren, ATF Agents, and US Marshals who were knocking on the door.
