On February 14, 2017 at 7:25 p.m., [redacted] was sitting in the driver's seat of his BMW convertible which was parked in front of 662 Blake Avenue in Brooklyn. [redacted] was having a conversation with [redacted] who was in the passenger seat. At this time, Police Officer Mordecai Austrie and Police Officer James Argila of the 75th Precinct pulled up behind [redacted] in an unmarked car with their lights on. Police Officer Austrie approached [redacted] vehicle on the driver's side and asked him for identification and registration (Allegation A).
[redacted] initially argued with Police Officer Austrie but provided his identification and registration shortly after. Police Officer Austrie then asked [redacted] to exit the vehicle but he refused to do so until Police Officer Austrie spoke with a supervisor. Police Officer Austrie called for a supervisor and requested [redacted] identification which she provided (Allegation B). Sergeant Jeffrey Liu, Police Officer Derick Russ, and Police Officer Tariq Grant of the 75th Precinct arrived in a second police vehicle shortly after. Police Officer Kevin Morgan and Police Officer Marc Whirl of the 75th Precinct arrived in a third vehicle around the same time.
Sergeant Liu asked [redacted] to step out of the vehicle and [redacted] complied. Police Officer Austrie conducted a frisk and search of [redacted] person after he stepped out of the vehicle (Allegations C and D). Sergeant Liu asked [redacted] to exit the vehicle and she complied. Sergeant Liu then asked [redacted] for permission to look into her bag and she permitted him to do so. [redacted] and [redacted] were directed to stand at the back of the vehicle while, under the direction of Sgt. Liu, Police Officer Austrie conducted a search of the interior of the vehicle (Allegation E). Police Officer Grant told [redacted] that he drove "an old ass car" and called it a "piece of shit," (Allegation F).
