On July 29, 2017, PO Alex Viera and PO Umar Khitab, from the 77th Precinct, conducted a stop of an Uber vehicle belonging to an unidentified individual and containing [redacted] and an additional unidentified passenger, as a result of a radio run involving a firearm (Allegations A and B: Abuse of Authority, [redacted]). During the stop, PO Viera frisked [redacted] (Allegation C: Abuse of Authority, [redacted]) and searched the Uber vehicle (Allegation D: Abuse of Authority, [redacted]). Backup officers from the 77th Precinct then arrived on scene. PO Patrick Craig punched [redacted] in the face (Allegation E: Force, [redacted]) and spoke discourteously to [redacted] (Allegation F: Discourtesy, [redacted]). PO Khitab and PO Rosiello also searched the Uber vehicle (Allegations G and H: Abuse of Authority, [redacted]). PO Khitab pushed [redacted] (Allegation I: Force, [redacted]). PO Viera pulled [redacted] into the police vehicle by his braids (Allegation J: Force, [redacted]) and spoke discourteously to [redacted] (Allegation K: Discourtesy, [redacted]). PO Craig then refused to provide his name to [redacted] (Allegation L: Abuse of Authority, [redacted]). [redacted] was issued a criminal summons for disorderly conduct as a result of this incident (Allegation M: Abuse of Authority, [redacted]) and [redacted] who were inside of [redacted] s third floor apartment at [redacted] were witnesses to this incident.
IAB Group 54 conducted a concurrent investigation into this incident. As of January 30, 2018, that investigation was still ongoing.
