On December 8, 2017, at approximately 5:38 p.m., [redacted] contacted the police to aid in family dispute, which involved her ex-boyfriend, [redacted] and their [redacted] old daughter, in the parking lot of 1434 C Richmond Road in Staten Island. PO Kristen Caldararo and PO Robert Ruhl, from the 122nd Precinct responded to the location and spoke to [redacted] who was standing outside of his car. A few minutes later, PO Caldararo and PO Ruhl approached [redacted] who was still inside of her car. PO Caldararo asked [redacted] for her identification and asked her whose visitation day it was. After handing PO Caldararo her driver's license, [redacted] explained that it was [redacted] visitation day and that she has numerous domestic incident reports in the system as their daughter refuses to go with [redacted] During that time, [redacted] only informed PO Caldararo that her right hand was in pain and PO Caldararo informed her that she was not filing a report. After that PO Caldararo asked [redacted] to speak with her daughter who was inside of her car.
After speaking with [redacted]'s daughter, PO Caldararo informed [redacted] that she would file a custody report for [redacted] as [redacted] would not allow their daughter to go with [redacted] PO Caldararo and PO Ruhl left [redacted] to speak with [redacted] and [redacted] went back inside of her car. A few minutes later, PO Caldararo and PO Ruhl returned to [redacted] and PO Caldararo handed [redacted] her driver's license. At that point, [redacted] asked PO Caldararo why she would not file a complaint as she was in pain, and PO Caldararo responded, "Because he's making allegations and so are you, and if you're both making allegations then both of you will be arrested and your daughter can go to ACS" (Allegation A: Abuse of Authority, [redacted]) After PO Caldararo made the statement, [redacted] asked her for her name but PO Caldararo did not respond (Allegation B: Abuse of Authority, [redacted])
