On March 31, 2018, at approximately 12:50 a.m., at Hamilton Avenue and Centre Street in Brooklyn, Police Officer Fernando Lopes of the 76th Precinct and Sergeant Ryan Monteleone of the 103rd Precinct were conducting a vehicle stop. PO Lopes and Sgt. Monteleone sat inside their vehicle parked behind the stopped vehicle, when they observed [redacted] standing in the street and speaking with the stopped motorist. The officers exited their vehicle, and PO Lopes allegedly stated, "What the fuck are you doing," and "Get the fuck away from the car," to (Allegation A: Discourtesy - [redacted]). The officers then approached [redacted] and PO Lopes allegedly pushed [redacted] from the street onto the sidewalk (Allegation B: Force 1). Once on the sidewalk, PO Lopes allegedly grabbed [redacted] cell phone, which had been recording video footage, from his hand and threw it on the ground, which cracked the screen (Allegation C: Abuse of Authority [redacted] 1) (Allegation D: Abuse of Authority - [redacted] 1). PO Lopes then handcuffed [redacted] and allegedly stated, "If you move, I'll slam you on your face," to [redacted] (Allegation E: Abuse of Authority 1). PO Lopes and Sgt. Monteleone then transported [redacted] to the 76th Precinct stationhouse. While the officers escorted [redacted] into the stationhouse, he complained of injuries. PO Lopes allegedly responded that if [redacted] said anything about going to the hospital at the stationhouse, he would be taken to jail. PO Lopes and Sgt. Monteleone then allegedly did not obtain medical treatment for [redacted] (Allegation F: Abuse of Authority [redacted] (Allegation G: Abuse of Authority - [redacted])).
