On May 30, 2018, at approximately 7:50 a.m., [redacted] called 911 and reported that she had been poisoned by a male she had met online and was having difficulty breathing. Police Officer Ian Gallagher, Police Officer Davit Osmanovic, Police Officer Richard Cruz, and Sergeant Peter Congolasi of the 46th Precinct responded to [redacted] residence, at [redacted], in the Bronx along with Emergency Medical Technicians (EMTs) (Board Review 01). When they arrived, [redacted] was evaluated by the EMTs but indicated that she did not wish to go to the hospital. Police Officer Gallagher allegedly said, "No, you are going to the fucking hospital" (Allegation A: Discourtesy-Word; [redacted]). Police Officer Cruz allegedly said, "No detective is going to come out here for this shit" (Allegation B: Discourtesy-Word; [redacted]). [redacted] in response, exited the ambulance and walked back into her apartment. Police Officer Gallagher and Police Officer Osmanovic followed her and Police Officer Gallagher allegedly said, "Don't close that fucking door. We are going to kick that fucking door in," (within Allegation A) and both officers entered the apartment behind [redacted] (Allegation C: Abuse of Authority-Entry, [redacted] Allegation D: Abuse of Authority-Entry, [redacted]).
Inside the apartment, Police Officer Cruz allegedly opened [redacted] medicine cabinet in her kitchen, took all of her medicine bottles out of the cabinet and poured the contents of the bottles onto the table and said, "Are you sure you did not take too much of them?" (Allegation E: Abuse of Authority- Search of Premises; [redacted]). An unidentified officer allegedly said to [redacted], "We don't give a fuck.
