On July 12, 2018, at approximately 11:30 a.m., [redacted] was standing on the sidewalk in front of [redacted] in the Bronx with his friends, [redacted] and [redacted] (last name unknown). Sergeant Elvin Pichardo of the 46th Precinct was in a vehicle and assigned to an observation post in a Street Narcotics Enforcement Unit (SNEU) operation. Police Officer Pichardo made observations of [redacted] and told the officers in the two vehicles behind him, which were also a part of the SNEU operation, that [redacted] appeared to be smoking a marijuana cigarette. Police Officer Kristi Skehill, Police Officer Nicholas Kourounis, Police Officer Konti Markvukaj, and Police Officer Theresa Lustica, all from the 46th Precinct, exited their vehicles and Police Officer Markvukaj stopped [redacted] (Allegation A – Abuse of Authority – Stop, [redacted]).
The officers allegedly also stopped [redacted] (Allegation B – Abuse of Authority Stop, [redacted]). Police Officer Markvukaj observed [redacted] place what he believed to be a marijuana cigarette in his mouth. Police Officer Markvukaj approached [redacted] and used one hand to grab [redacted]'s face in the lower jaw and cheek area, causing [redacted]'s mouth to open (Allegation C – Abuse of Authority – Body Cavity Searches, [redacted]).
