On October 16, 2019, at approximately 11:45 p.m., [redacted] was walking with his wife, [redacted] and his two friends, [redacted] and [redacted] got into a brief argument with [redacted] who had been arguing with an unknown woman on the street. [redacted] then went inside a store, and [redacted] remained outside with [redacted] While outside, two police cars drove up to [redacted] and two officers, PO Matthew Sabella of the 67th precinct, and PO Christian Cayenne of Patrol Borough Brooklyn South, exited from the vehicle and approached [redacted] The officers began to pull an unidentified object out of their belt and told [redacted] to "hold on" (Allegation A and B: Abuse of Authority; [redacted] This caused [redacted] to fear for this life, and he began to run away. He heard an officer yell "Get that motherfucker" as PO Sabella and PO Cayenne began pursued him, along with additional units (Allegation C: Discourtesy; [redacted]).
[redacted] stopped running and turned around, where he observed PO Sabella running towards him allegedly yelling "Get on the fucking ground" (Allegation D: Discourtesy; [redacted] PO Sabella then tackled [redacted] to the ground and told officers to "get his ass" (Allegation E: Force; [redacted] and Allegation C, cont.). PO Sabella and other unidentified officers allegedly began to punch and kick [redacted] while he was on the ground (Allegation F: Force; [redacted]). [redacted] was then handcuffed and stood up, where he asked PO Sabella for his name and shield number, he allegedly refused to provide (Allegation G and H: Abuse of Authority; [redacted] was put into a police vehicle by PO Matthew Kelly, also of the 67th Precinct, for transportation to the 67th Precinct stationhouse in Brooklyn. Prior to being placed in the vehicle, unidentified officers allegedly commanded [redacted] to give his "fucking hands and arms" (Allegation I: Discourtesy; [redacted]).
