Summary

On October 24, 2018, at approximately 11:27 a.m., [redacted] was riding his electric scooter in the vicinity of Sutphin Boulevard in Queens when Police Officer Frank Gagnon and Police Officer Jhoan Lozano of the 113th Precinct attempted to pull him over for operating an illegal motorized scooter in a reckless manner. [redacted] continued riding to his residence at [redacted] in Queens [redacted] unit), entered his residence, and closed the door behind him. Police Officer Gagnon and Police Officer Lozano told [redacted] that they would take his scooter if he did not come downstairs (Allegations A and B – Abuse of Authority: Threat to Seize Property, [redacted]) [redacted] then exited the building. A physical struggle between [redacted] and the officers ensued on the stairs that ascend from the front door to the second floor. Police Officer Gagnon and Police Officer Lozano punched [redacted] (Allegations F and G – Force: Physical Force, [redacted]) and Police Officer Gagnon tased [redacted] (Allegation H – Force: Nonlethal Restraining Device, [redacted]). The struggle moved outside, where he was allegedly punched and kicked by Police Officer Gagnon, Police Officer Lozano, Police Officer Louis Wirth, Police Officer Damien Lombardo, Police Officer Richard Miqueli, and Police Officer Manuel Goico of the 113th Precinct (Allegations F, G, J, K, L, and M – Force: Physical Force, [redacted]).
