On November 28, 2018, at approximately 10:45 p.m., [redacted]'s vehicle was pulled over by PO Brett Heagneysciamatore and PO Franklyn Santana of the 41st Precinct Anti-Crime Unit on Bruckner Expressway in the Bronx (Allegations A and B: Abuse of Authority, [redacted]). PO Santana allegedly asked [redacted] if he had any weapons in the vehicle (Allegation C: Abuse of Authority, [redacted]). PO Santana asked [redacted] if he could search the car and [redacted] consented to the vehicle search. PO Santana allegedly frisked and searched [redacted] while Heagneysciamatore searched his vehicle (Allegations D, E, and F: Abuse of Authority, [redacted]). After the vehicle search, PO Heagneysciamatore gave [redacted] his wallet and information back and he was allowed to leave without being issued a summons. Upon leaving, [redacted] noticed PO Heagneysciamatore did not return his license (Allegation G: Abuse of Authority, [redacted]).
On November 29, 2018, at approximately 9:30 p.m., [redacted] was pulled over again by PO Heagneysciamatore and two other plain-clothed officers (Allegation H: Abuse of Authority, [redacted]; Allegation I: Abuse of Authority, [redacted]). The officers asked [redacted]'s license and registration and if he had any weapons in the car (Allegation J: Abuse of Authority, [redacted]). [redacted] replied that PO Heagneysciamatore did not return it on the prior night he was stopped and [redacted] was allowed to leave without being issued a summons.
