Summary

On November 16th, 2018 at around 6:58pm, [redacted] entered his apartment at [redacted] in Manhattan and observed that his apartment appeared to have been burglarized. [redacted] called 911 to request police assistance. When Police Officer Daniel Wynne and Police Officer Gerald Mortimor, both of the 34th Precinct, arrived, [redacted] asked them to check around the apartment for signs of a break-in. PO Wynne and PO Mortimor entered the apartment and looked around, then told [redacted] that they would not be making a report.
[redacted] called 911 again to request for additional officers to make a report for him. PO Wynne and PO Mortimor remained on scene with [redacted] while they waited for more officers to arrive. When Police Officers Daniel Snyder, Ronald Capursi, and Sergeant Joan Ferreira, all of the 34th Precinct, arrived, [redacted] told them that the apartment had been broken into. They asked him if he was on medication, then these officers entered the apartment. After he entered the apartment, PO Capursi came back into the hallway with one of [redacted]'s prescription medication bottles which he allegedly found in the apartment (Allegation A: Abuse of Authority, [redacted]). PO Capursi told [redacted] they would take him to hospital, handcuffed him, then [redacted] was transported to [redacted] by officers in the back of an RMP (Allegation B: Abuse of Authority, [redacted]).
